Licensed Victuallers 1801 - 1828

The following are transcriptions of the approval of Licensed Victuallers (Publicans), recorded under Quarter Sessions.

These are for the ‘North Shebbear and Hartland Division’, but are sometimes said to be the ‘Bideford Sessions’, even though Bideford was not included in this area.

The name of the person requesting a License is recorded, together with the person who agreed to stand as Surety for their keeping an orderly house.

The documents are housed in Devon Record Office (see reference number against each year).  Surviving documents start from 1728.  This batch covers 1801 to 1828.  (N.B: Pub names do not start appearing against licensees names unto c.1822 -  except for 1798, which helpfully did record the "Sign" of the House. ).

Be it remembered that on the 15th day of September in the year of our Lord 1801 the several and respective victuallers and their sufficient sureties hereinafter mentioned came before us John Clevland esquire and Thomas Saltren and William WALTER clerks three of his Majesty's Justices of the Peace for the said County acting for the hundreds of Shebbear North and Hartland in the said County And each of the said victuallers did acknowledge themselves to owe to our Lord King George the Third the sum of £10 a piece, and the several sureties for themselves in £5, and in case of the absence of the said victuallers two sureties in the sum of £10 to be levied on their several goods and chattles lands and tenements.

Upon condition that each of the said victuallers hereafter named do severally keep good rule and order in their respective houses, yards, gardens, or backsides pursuant to the licenses to them now granted for one year in such manner as the law in that case directs, then their

respective recognizances to be void or otherwise to remain in full force and effect.

42nd George the Third 1802 - Devon to wit.

Be it remembered that on the 7th day of September in the year of our Lord 1802 the several and respective victuallers and their sufficient sureties hereinafter mentioned came before us his Majesty's Justices of the Peace for the said County acting for the hundreds of Hartland and Shebbear North in the said County and acknowledged themselves to owe to our sovereign Lord the King that is to say the said victuallers the sum of £10 a piece and the several sureties the sum of £5 each and in case of the absence of the said victuallers two sureties in the sum of £10 to be levied on their respective goods and chattles lands and tenements.

Upon condition that each of the said victuallers hereafter named do severally keep good rule and order in their respective houses, yards, gardens or backsides pursuant to the licenses to them now granted for one year in such manner as the law in that case directs, then their respective recognizances to be void otherwise to remain in full force.

Be it remembered that on the 12th day of September in the year of our Lord 1804 the several and respective victuallers and their sufficient sureties hereinafter mentioned came before us Peter Wellington Furse and Peter Glubb clerks two of his Majesty's Justices of the Peace for the said County acting for the hundreds of Hartland and Shebbear North in the said county, and each of the said victuallers did acknowledge themselves to owe to our Lord the King the sum of £10 a piece, and the several sureties £5, and in case of the absence of the said victuallers two sureties in the sum of £10 to be levied on their several goods and chattles lands and tenements.

Be it remembered that on the 4th day of September in the year or our Lord 1805 the several and respective victuallers and their sufficient sureties hereinafter mentioned came before us Peter Wellington Furse, Thomas Saltren and Peter Glubb clerks three of his Majesty's Justices of the Peace for the said county acting for the hundreds of Shebbear North and Hartland, in the said county and each of the said victuallers did acknowledge themselves to owe to our Lord the King the sum of 310 a piece and the several sureties £5 and in case of the absence of the said victuallers two sureties in the sum of £10 to be levied on their respective goods and chattles lands and tenements.

Upon condition that each of the said victuallers hereinafter named to severally keep good rule and order in their respective houses, yards, gardens or backsides pursuant to the licences to them now granted for one year in such manner as the law in that case directs, then the respective recognizances to be void otherwise to remain in full force and effect.

Be it remembered that on the 4th day of September 1816 the several persons whose names are hereunder written as innkeepers and the several persons whose names are hereunder written as their sureties personally came before us Richard Pine Coffin, James Burke and Edward Lee esquires and Peter Glubb clerk Justices of the Peace for the said county and acknowledged themselves to owe to our Sovereign Lord the King the several sums set against their respective names if the said innkeepers shall make default in the condition under written.

Now the condition of this recognizance is such that if the several victuallers under mentioned do keep good order and government and suffer no disorders thereunto belonging pursuant to their licences now granted to them respectively until the next general licensing day of victuallers, then these recognizances respectively shall be void or else to remain in full force.

Upon condition that each of them the said victuallers hereinafter named do severally keep good order in their respective houses yards gardens and backsides pursuant to the certificate now granted for one whole year in such manner as the law in that case directs, then the respective recognizances to be void otherwise to remain in full force and effect.

Be it remembered that on the 5th day of September in the year of our Lord 1821 the several and respective victuallers and their sufficient sureties hereinafter mentioned came before us The Reverend Peter Glubb, Richard Pine Coffin and James Burke esquires three of his Majesty's Justices of the peace for the said county of Devon and acknowledged themselves to owe to our sovereign Lord the King the several sums set against their respective names [ie: £10] to be made and levied of their several goods and chattles lands and tenements respectively to his Majesty's use.

Upon condition that each of the said victuallers hereinafter named do severally keep good order in their respective houses yards gardens and backsides pursuant to the certificate now granted for one year in such manner as the law in that case directs then the respective recognizances to be void otherwise to remain in full force and effect.

The following typical standard printed form was filled in with particular details for each establishment.

These documents exist up to 1828, but certificates after this date do not appear to have survived.

The following names have been extracted from a printed transcript in the Devon Record Office catalogue.

Further details of Surety's names, amounts pledged, etc, can be gained by examining each certificate.]

Devon to wit.

At a [General] Meeting of His Majesty's Justices of the Peace acting in and for the Division [of Bideford] held at [NAME OF PLACE] in the Division and County aforesaid on [DATE] [LANDLORD'S NAME] at the Sign of [ALE-HOUSE NAME] in the parish of [PARISH] victualler, acknowledges himself to be indebted to our Sovereign Lord the King, in the sum of [AMOUNT] pounds, [SURETY'S NAME, OCCUPATION and ABODE] acknowledges himself to be indebted to Our Sovereign Lord the King in the Sum of [AMOUNT] pounds.

To be levied upon their several Goods and Chattels, Lands and Tenements, by way of Recognizance to His Majesty's Use, His Heirs and Successors, upon Condition that the said [LANDLORD'S NAME] do and shall keep the true Assize in uttering and selling Bread and other Victuals, Beer, Ale, and other Liquors in his, her, or their House, and shall not fraudulently dilute or adulterate the same, and shall not use, in uttering and selling thereof, any Pots or other Measures that are not of full Size, and shall not wilfully or knowingly permit Drunkeness or Tippling, nor get drunk in his, her, or their House or other Premises; nor knowingly suffer any gaming with Cards, Draughts, Dice, Bagatelle, or any other sedentary Game in his, her, or their House, or any of the Outhouses, Appurtenances, or Easements thereto belonging, by Journeymen, Labourers, Servants, or Apprentices; nor knowingly introduce, permit, or suffer any Bull, Bear, or Badger-baiting, Cock-fighting, or other such Sport or Amusement in any Part of his, her, or their Premises; nor shall knowingly or designedly, and with a View to harbour and entertain such, permit or suffer Men or Women of notoriously bad Fame, dissolute Girls and Boys, to assemble and meet together in his, her, or their House, or any of the Premises thereto belonging; nor shall keep open his, her, or their House, nor permit of suffer and drinking or tippling in any Part of his, her, or their Premises during the usual Hours of Divine Service on Sundays; nor shall keep his, her, or their House or other Premises during late Hours of the Night, or early in the Morning, for any other Purpose than the reception of Travellers, but do keep good Rule and Order therein according to the Purport of a Licence granted for selling Ale, Beer, or other Liquors by Retail in the said House and Premises for one whole Year, commencing on the Tenth Day of October next, then this Recognizance to be void, or else to remain in full force.
